SEBI’s circular dated 4 November allows specified individuals outside India to submit KYC information and supporting documents digitally, subject to country eligibility, identity checks and secure verification.

The framework covers individual Persons Resident Outside India, including NRIs, OCIs and foreign nationals. It also addresses reuse of existing records, PAN verification, overseas address proof and video verification. As of 5 November, the circular is notified but its stated commencement date is still ahead. Read the official SEBI circular.

NRI digital KYC at a glance

Item

What the circular says

Issue date

4 November 2026

Effective date

3 December 2026, expressly stated in paragraph 7

Covered clients

Individual Persons Resident Outside India: NRIs, OCIs and foreign nationals

Digital access from abroad

Available under the framework for an eligible client located in a FATF-compliant country

Clients in non-compliant countries

The existing KYC process continues

Who can use the overseas digital route

The client’s non-resident status, physical location and investment route need to be considered together. The circular refers to a Person Resident Outside India under section 2(w) of the Foreign Exchange Management Act, 1999. An overseas passport or OCI card alone does not answer every residence or product-eligibility question.

The location relaxation applies to eligible individual clients in FATF-compliant countries. Ask the intermediary to check the current country position and its implementation process. A foreign national seeking registration as a Foreign Portfolio Investor must follow the separate FPI framework identified in paragraph 6. The intermediary may accept digital KYC information and supporting records from an eligible overseas client. Identity verification and security controls remain part of the process. (SEBI circular, paragraphs 4.1 and 5.1.)

2 Existing KYC records should be retrieved first

The intermediary seeks the client’s PAN and CKYC ID, if available, and retrieves records from the KRA and Central KYC Records Registry. Further details may be required when records change, are incomplete, do not meet current norms or contain expired documents. Identity or address verification, enhanced due diligence and risk profiling can also justify additional information. (SEBI circular, paragraphs 5.2 to 5.4.)

3 PAN is verified against the tax database

The intermediary collects the PAN and checks it with the Income Tax Database without insisting on the original PAN card or a copy. The KRA also verifies PAN and the name in the KYC form. Passport copies and an OCI card, where applicable, are collected separately. (SEBI circular, paragraphs 5.5.1 and 5.5.2.)

4 Overseas address and contact details receive clear treatment

For the covered client, the current address is the overseas address. The circular permits an Indian or international mobile number and requires verification of email. Mobile verification is undertaken where feasible; if the mobile cannot be verified, communications must go to the verified email. (SEBI circular, paragraphs 5.5.5 and 5.5.7.)

Check that names, dates and address details agree across the form and accepted documents. Where an address or identification document is in another language, obtain the required English translation and attestation before submission. This preparation can prevent an avoidable request for clarification.

5 Portable records can still require further checks

KRAs tag individual attributes as validated when verified with an official or source database. Records can be shared with another intermediary even if every attribute is not validated. The receiving intermediary remains responsible for its client’s KYC and appropriate due diligence. Portability therefore helps records move; it does not promise automatic account approval. (SEBI circular, paragraphs 4.2 and 5.6.)

What documents should an NRI prepare

Use this preparation list, then confirm the accepted documents and submission method with the intermediary:

PAN, and the CKYC identifier if available.

Passport copy and OCI card where applicable.

The individual KYC form and specimen signature in the permitted format.

Accepted officially valid or deemed officially valid documents for identity and overseas address.

Accessible email and an Indian or international mobile number.

Original-document verification or an accepted alternative, with English translations and attestation where required.

The circular allows alternatives to presenting an original document, including specified verifiable e-documents, Aadhaar e-KYC authentication or copies attested by the listed certifying authorities. A simple uploaded scan should not be assumed to meet every verification condition. Certified copies must carry the prescribed certification details. (SEBI circular, paragraphs 5.5.3 to 5.5.7 and 5.9.)

How video verification will work

Where physical in-person verification is not feasible, the intermediary undertakes Video In Person Verification, or VIPV. Its authorised official must be present. The process includes recorded consent, live interaction, location and time capture, photo matching, liveness checks and security safeguards. It is subject to concurrent audit.

The captured IP location must be from India or an eligible FATF-compliant country and match the country in the KYC form and address document. Systems must prevent connections through spoofed IP addresses, VPNs or proxy servers. If you are travelling, ask whether the location and document details satisfy the requirements before starting. (SEBI circular, paragraph 5.5.8.)

Where a specimen signature is submitted digitally, the client must also make a wet signature during VIPV so the intermediary can compare it with the submitted image. Keep the accepted identity document and a pen ready for the session. (SEBI circular, paragraph 5.5.4.)

A practical onboarding sequence

1. Confirm your residence category, investment route, current location and the intermediary’s readiness for the framework.

2. Provide PAN and the available CKYC identifier so existing records can be retrieved.

3. Correct changed or incomplete information and arrange acceptable documents and translations.

4. Complete the prescribed form, signature and original-document verification steps.

5. Complete IPV or the intermediary’s compliant VIPV process, as applicable.

6. Retain the acknowledgement and confirm the account’s operating status before placing transactions.

These are preparation steps, not a promised approval timetable. Paragraph 5.7 requires the intermediary to send completed KYC information to the KRA within three working days after completion of the KYC process. That reporting period should not be read as a guarantee that every application will be approved within three days.

What happens to re KYC and older records

The process also applies to re-KYC for a client in a FATF-compliant country. On commencement, the circular supersedes the specified earlier provisions, including the 10 December 2025 NRI geo-tagging circular. KYC completed before commencement continues to be governed by the earlier provisions; the circular does not require everyone’s existing records to be discarded. (SEBI circular, paragraphs 5.10 and 8.)

Keep KYC alongside the wider financial review. It should not be described as already operational on its 4 November issue date.

Can an NRI complete KYC digitally from every country

The new overseas-location relaxation is subject to the FATF-compliant-country condition and the prescribed checks. For clients in non-compliant countries, the existing process continues.

Must every NRI have an Indian mobile number

The circular permits an Indian or international number. Email must be verified; mobile verification is required where feasible, with communications directed to verified email if the number cannot be verified.

Does the circular remove passport or identity verification

No. It specifies passport, applicable OCI, identity, address and verification requirements. PAN verification against the tax database is one part of that process.

Does portable KYC guarantee that another intermediary will open the account

No. Records may be shared, but the intermediary retains responsibility for KYC and risk-based due diligence.

Can a foreign national use this circular instead of the FPI framework

A foreign national seeking FPI registration must follow the applicable FPI framework, as paragraph 6 specifically provides.

What to do now

Prepare consistent records and ask your intermediary how it will implement the framework from 3 December 2026.
