{"id":5,"date":"2026-09-10T11:55:40","date_gmt":"2026-09-10T11:55:40","guid":{"rendered":"https:\/\/wealth4india.com\/Insights\/?p=5"},"modified":"2026-09-10T16:01:25","modified_gmt":"2026-09-10T16:01:25","slug":"whatsapp-chats-section-69-addition-important-itat-pune-ruling-on-third-party-evidence","status":"publish","type":"post","link":"https:\/\/wealth4india.com\/insights\/whatsapp-chats-section-69-addition-important-itat-pune-ruling-on-third-party-evidence\/","title":{"rendered":"WhatsApp Chats Section 69 Addition: Important ITAT Pune Ruling on Third-Party Evidence"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Can the Income Tax Department treat an amount as unexplained investment merely on the basis of WhatsApp chats recovered from somebody else&#8217;s mobile phone?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The recent decision of&nbsp;<strong>ITAT Pune in Rameshwar Fakirchand Totala v. ITO, Ward-1(1), Aurangabad, ITA No. 1303\/PUN\/2026, dated 21 August 2026<\/strong>, provides an important perspective on this issue.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Assessing Officer had made an addition of&nbsp;<strong>\u20b910,52,450 under Section 69<\/strong>&nbsp;on the allegation that WhatsApp chats recovered from a third party&#8217;s phone reflected Bhisi payments by the assessee.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The CIT(A)\/NFAC sustained the addition.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The ITAT, however, deleted it.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Why was the Section 69 addition deleted?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The principal difficulty in the Revenue&#8217;s case was the absence of independent evidence demonstrating that the assessee had actually made the alleged investment or payment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The WhatsApp chats had been recovered from the mobile phone of another person.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There was no sufficient independent evidence such as movement of funds, bank transactions or other corroborative material proving the alleged investment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Tribunal also considered the authentication of the electronic evidence.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Section 132(4A) presumption and third-party evidence<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">An important aspect of the ruling concerns the presumption under Section 132(4A).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The ITAT held that such presumption could not automatically be extended against another taxpayer merely because his name or mobile number appeared in material found during a search from a third party.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Revenue was required to establish an independent connection between the recovered material and the assessee.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This makes the judgment relevant for cases involving not only WhatsApp chats but also&nbsp;<strong>third-party Excel sheets, diaries, loose papers, emails and other digital records<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Can WhatsApp chats still be used as evidence?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Yes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The decision should not be interpreted to mean that WhatsApp chats are never relevant in income-tax proceedings.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The evidentiary strength becomes very different where digital records are supported by:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u2022 bank transactions;<br>\u2022 cash trails;<br>\u2022 seized books or documents;<br>\u2022 asset purchases;<br>\u2022 statements or admissions; or<br>\u2022 other independent corroborative evidence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, the more accurate principle is:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Unauthenticated third-party WhatsApp chats, without sufficient independent corroboration, should not automatically be treated as proof of an unexplained investment under Section 69.<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What taxpayers should do<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">If you receive an income-tax notice based upon third-party information, do not restrict the reply merely to denying the transaction.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Examine:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>where the material was recovered;<\/li>\n\n\n\n<li>how the electronic evidence was authenticated;<\/li>\n\n\n\n<li>whether the complete material has been supplied;<\/li>\n\n\n\n<li>what connects the material with you;<\/li>\n\n\n\n<li>whether an actual money trail exists; and<\/li>\n\n\n\n<li>whether independent corroborative evidence supports the allegation.<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">Professional representation in&nbsp;<a href=\"https:\/\/caalokkumar.com\/tax-litigation.html\" target=\"_blank\" rel=\"noopener\">income tax search, reassessment, faceless assessment and appellate proceedings<\/a>&nbsp;should address both the factual evidence and the legal admissibility\/reliability of material relied upon by the Department.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Readers may also refer to our earlier analysis of an ITAT Mumbai ruling concerning&nbsp;<a href=\"https:\/\/caalokkumar.com\/my-writing\/section-69a-third-party-mobile-entries-itat-mumbai-naresh-chheda\/\" target=\"_blank\" rel=\"noopener\">Section 69A addition based on third-party mobile entries and WhatsApp chats<\/a>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Read the detailed case analysis<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">\ud83d\udc49&nbsp;<a href=\"https:\/\/caalokkumar.com\/my-writing\/whatsapp-chats-section-69-addition\/\" target=\"_blank\" rel=\"noopener\">WhatsApp Chats Section 69 Addition \u2013 Rameshwar Fakirchand Totala v.
